Privacy Notice Regarding the Processing of Personal Data Pursuant to Article 13 of EU Regulation 679/2016

1. Subject of the Privacy Notice

Pursuant to Article 13 of EU Regulation No. 679/2016 on the protection of natural persons with regard to the processing of personal data, the personal data you have provided (hereinafter, the ’User”) transferred directly to the company Ask4Location S.r.l.s. (hereinafter, the “Company”), will be processed in accordance with the aforementioned legislation and in accordance with the principles of lawfulness, fairness, transparency, and the protection of your privacy and rights, with particular reference to integrity, confidentiality, personal identity, and the right to the protection of personal data (hereinafter, the “Data”).

2. Types of Data Processed

2.1 Browsing data

Information systems and procedures software responsible for the operation of this website web ask4location.it, collect, in the course of their normal operations, certain data whose transmission is implicit in the browsing of websites web. This information is not collected to be associated with identified individuals; however, by its very nature, it could, through processing and association with data held by third parties, make it possible to identify users. This includes the IP addresses or domain names of the computers used by users connecting to the site, the URLs of the requested resources, the time of the request, and the method used to submit the request to the server, the size of the file the numeric code indicating the status of the response provided by server and other parameters related to the operating system and platform used by the User. The above data is used solely to obtain anonymous statistical information on the use of the site and to verify its proper functioning; it is deleted immediately after processing. The data may be used to determine liability in the event of hypothetical computer crimes against the site.

2.2 Data voluntarily provided by the User

The explicit and voluntary submission of data and/or email messages to the addresses listed on this website web ask4location.it including through forms (“form”) or other technological tools that may be made available, results in the subsequent collection of the sender’s email address—which is necessary to respond to your inquiries—as well as any other personal data included in the message you send.

3. Legal basis and purposes of the processing

By providing the Company with their personal data, the User expressly consents to the Company’s processing of such data in accordance with the terms and conditions set forth in this privacy policy and for the purposes described below.

The data provided by the User will be processed lawfully and fairly for purposes necessary to achieve the Company’s corporate objectives and, in any case, related to and instrumental to the Company’s activities, including:

  1. the filing and storage of data in paper files or using computer and/or electronic systems;
  2. the provision of the requested services by the Company;
  3. compliance with legal obligations;
  4. sending informational communications via email;

The data stored and processed is strictly personal and financial in nature. The processing does not involve special categories of data as defined in Article 9 of the GDPR 679/2016, nor does it involve personal data related to criminal convictions and offenses as defined in Article 10 of the GDPR 679/2016.

4. Nature of the contribution

The provision of the data referred to in points (a), (b), and (c) of Article 3 (Legal Basis and Purpose of the processing) is required. This processing is necessary to enable the Company to provide and manage the services it offers. If the User refuses to provide the Data, or if consent to its processing is not given, the Company will be unable to fully provide the services offered.

The provision of the data referred to in points (d) and (e) of Article 3 (Legal basis and Purpose of the processing) is optional. Failure to provide consent will not affect your ability to receive the requested services and will result solely in the consequences described below:

  • failure to consent to the processing of personal data for the purposes referred to in Article 3(d) (Legal basis and purposes of the processing), will result in your inability to receive informational communications from the Company;
  • failure to consent to the processing of personal data for the purposes referred to in point (e) of Article 3 (Legal basis and purposes of the processing), will prevent the Company from disclosing or transferring the Data to third parties (suppliers) for the purpose of providing the services requested and supplied by the Company.

5. Methods of processing

The data provided will be collected and stored for specific, explicit, and legitimate purposes. The Data will be entered into a database and/or stored in paper archives or using IT and/or telecommunications devices and by any other means made available by technology and technological advancements, in compliance with the security measures set forth in Article 32 of GDPR 679/2016, by specifically designated individuals, in compliance with the provisions of Article 29 of the GDPR 679/2016.

5.1 Storage

Pursuant to Article 5 of the GDPR (Regulation (EU) 2016/679), we hereby inform you that, in accordance with the principles of lawfulness, purpose limitation, and data minimization, the retention period for your data is set for a period not exceeding the time necessary to achieve the purposes for which it is collected and processed, and in compliance with the timeframes prescribed by law.

5.2 Scope of communication and dissemination

The Company may disclose the Data to public and private entities and, more generally, to any public or private party to whom the Company is required to disclose such information, including for the purpose of properly fulfilling any respective obligations (including those of an instrumental nature) in any way connected with or relating to present and future relationships to be established with you, as required by laws and/or regulations or for the achievement of the purposes set forth above. The Data will under no circumstances be disclosed.

5.3 Transfer of Data to Third Countries

The data is not transferred to third countries or international organizations.

7. User Rights

The User has the right to obtain from the data controller confirmation as to whether or not personal data concerning him or her are being processed and, if so, to obtain access to the personal data and to the following information:

  • the identity and contact details of the data controller and, where applicable, of its representative;
  • the contact information of the Data Protection Officer, where applicable;
  • the purposes for which the Personal Data is processed, as well as the legal basis for the processing;
  • where the processing is based on Article 6(1)(g), the legitimate interests pursued by the controller or by a third party,
  • any recipients or categories of recipients of the Personal Data;
  • where applicable, the controller’s intention to transfer personal data to a recipient in a third country or to an international organization, and the existence or absence of a Commission adequacy decision or, in the case of transfers referred to in Article 46 or the second paragraph of Article 47, a reference to the appropriate or suitable safeguards and the means to obtain a copy of such Data or the location where it has been made available;
